Terms and Conditions

 

These terms and conditions are between OCE Grading (“we”, “us” or “our”) and the customer (“you” or “your”). By clicking an acknowledgement box and/or making payment for our services, you acknowledge that you have read and agree to be bound by these Terms and Conditions (the “Agreement”). This Agreement is subject to your statutory consumer law rights, which cannot be excluded.

 

1. Service Timelines

We will use reasonable endeavours to complete our services within the estimated timeframes provided. Any dates we provide are estimates only, and while we will act with due diligence, we are not responsible for delays outside our control.

2. Shipping and Risk of Loss

​

You are responsible for arranging and paying for delivery of your cards to OCE Grading.

​

  • Inbound shipments (to us): We do not provide or arrange insurance for cards sent to us under any circumstance. You bear all risk for loss or damage until we have confirmed acceptance of delivery at our premises.

​

  • Return shipments (from us to you): Return shipping will only be insured if you have selected and paid for insurance on the submission form. The insured value for return shipping will match the insured value you nominated for your submission (see Section 4). If no insurance is purchased, cards are returned uninsured at your risk.

3. Authenticity and Rejected Items

​

We reserve the right to reject any item that shows evidence of alteration, tampering, or questionable authenticity.

​

  • In such cases, the grading service fee may not be refunded at our discretion, as costs are incurred in authentication and processing.

  • You also agree not to knowingly submit altered or counterfeit items.

​

4. Care, Insurance and Liability

4.1. Reasonable care
​

OCE Grading will exercise all reasonable precautions in the handling, grading, and storage of items submitted, including secure storage in a locked facility and use of appropriate protective measures.

4.2. While in our possession
​

Once delivery has been accepted by OCE Grading, we remain responsible for exercising reasonable care of your cards until they are handed over to the nominated return carrier.

​

4.3. Insurance cover and limits

​

  • Customers may nominate and purchase an insured value for their submission, up to a maximum of AUD $5,000 per submission.

  • Any nominated insured value will be apportioned evenly across all cards in the submission.

  • Example: 10 cards, $5,000 total insured = $500 insured value per card.

  • Example: 5 cards, $2,500 total insured = $500 insured value per card.

4.4. Compensation for insured submissions

If an insured item is lost or damaged while in our possession, compensation will be based on the apportioned insured value per card, subject to the maximum limit of AUD $5,000 per submission.

4.5. Uninsured submissions
​

If you do not purchase insurance, your cards are submitted entirely at your own financial risk. OCE Grading will continue to exercise reasonable care in handling and storing your cards. However, no compensation will be given or fiscal responsibility will be accepted for loss or damage to uninsured submissions under any circumstances.

4.6. Limitation of liability​

  • Insured submissions
    Compensation is limited to the nominated insured value (apportioned evenly per card), subject to a maximum of AUD $5,000 per submission.

 

  • Uninsured submissions
    No compensation will be payable for loss or damage.

4.7. Fair Market Value Limitation​


Any insured payout will not exceed the fair market value of the affected card(s) at the time of loss or damage, even if a higher insured value was nominated. Customers are responsible for ensuring that the nominated insured value reasonably reflects their card(s) market value. OCE Grading reserves the right to require evidence of fair market value (such as recent sales records or price guides) before any payout is made.

 

5. Returned Items and Defects​

If upon return of your submission (within a maximum timeframe of 7 days after receipt) you can demonstrate that we caused damage to your cards, and this is accepted by us without reasonable doubt:

​

  • We will compensate you for a value of the card, up to the apportioned amount of the insurance opted for ($5,000 AUD maximum apportioned per submission).

  • If labels or cases we supplied are mislabelled or defective, we will correct or replace them at no additional charge.

​

6. Photographs, Scans and Data​

​

In providing our services, we may create photographs, scans, and other data relating to your items.

​

  • You retain ownership of your cards, but by submitting them, you grant us a perpetual, royalty-free licence to use such images and data for record-keeping, training, marketing, or other business purposes.

  • We will be the owner of the created data and may use it as we deem appropriate.

​

7. Force Majeure

​

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including but not limited to natural disasters, fire, flood, strikes, acts of government, or failures of shipping carriers.

8. Entire Agreement and Precedence

​

This Agreement constitutes the entire agreement between OCE Grading and you in relation to our services. If there is any inconsistency between this Agreement and any submission form, order confirmation, or other document, this Agreement will prevail.

​

9. Governing Law

​

This Agreement is governed by the laws of Queensland, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of that State for any disputes.
